Terms of Service for Aeva

Aeva is an AI-powered recipe assistant that helps users save, import, organise, and manage recipes. Aeva allows users to create cookbooks, manually add recipes, upload recipe photos, import recipe content, favourite recipes, and plan meals.

Aeva is provided by Aeva AI.

You must be at least 13 years old to use Aeva.

By using Aeva, you confirm that you are legally able to enter into these Terms and that your use of the app complies with all applicable laws.

To use Aeva, you do not need an account but it is recommended to do so to be able to sync all your recipes.

When creating an account, you agree to provide accurate and current information. You are responsible for keeping your login details secure and for all activity that occurs under your account.

You must notify us immediately if you believe your account has been accessed without your permission.

Aeva requires a paid subscription to use.

Subscriptions are purchased through the Apple App Store using Apple's in-app purchase system. Your subscription will be charged to your Apple ID account.

Subscriptions may automatically renew unless cancelled through your Apple account settings before the renewal date.

Subscription pricing, billing periods, free trials, renewals, cancellations, and refunds are handled by Apple in accordance with Apple's App Store terms and policies.

Aeva AI does not directly process App Store payments and cannot directly cancel your Apple subscription for you. You are responsible for managing or cancelling your subscription through your Apple account settings.

We may change subscription features, pricing, or availability from time to time, subject to Apple's rules and applicable law.

You may create, upload, save, or import content into Aeva, including recipes, ingredients, cooking steps, cookbook names, recipe photos, meal plans, notes, favourites, and shared recipe links.

This content is referred to as User Content.

You retain ownership of your User Content. By using Aeva, you give Aeva AI permission to store, process, display, organise, and use your User Content only as needed to provide and improve the app's features.

For example, Aeva may process your recipe links, uploaded photos, ingredients, steps, or recipe text so the app can extract, format, save, and display your recipes.

You are responsible for ensuring that you have the right to upload, save, or import any content you add to Aeva.

Aeva does not allow users to publicly share recipes with other users.

Your recipes, cookbooks, uploaded photos, favourites, and meal planning data are intended to be private to your account.

Aeva uses AI-powered features to help extract and organise recipe information from shared links, text, webpages, and other recipe content.

AI-generated outputs may be incomplete, inaccurate, or incorrectly formatted. Aeva does not guarantee that imported recipes, ingredients, steps, serving sizes, cooking times, or other generated information will always be correct.

You are responsible for reviewing all imported or AI-generated recipe information before relying on it.

Aeva is a recipe organisation and meal planning tool only.

Aeva does not provide medical, nutritional, dietary, allergy, or professional food safety advice.

You are responsible for checking:

• Ingredients
• Allergens
• Dietary suitability
• Cooking temperatures
• Food preparation safety
• Expiry dates
• Portion sizes
• Any health-related concerns

Do not rely on Aeva as a substitute for professional medical, dietary, nutritional, or food safety advice.

If you have allergies, medical conditions, dietary restrictions, or food safety concerns, you should consult a qualified professional before relying on any recipe.

Aeva uses third-party services to operate and improve the app. These may include:

• Firebase
• Google Cloud
• OpenAI
• Apple App Store services

These services may process limited data as needed to provide authentication, database storage, cloud infrastructure, AI recipe extraction, app functionality, subscriptions, analytics, crash reporting, or related services.

Your use of Aeva may also be subject to the terms and privacy policies of those third-party services.

You agree not to misuse Aeva.

You must not:

• Use Aeva for unlawful purposes
• Upload harmful, abusive, offensive, illegal, or infringing content
• Attempt to hack, damage, overload, or disrupt the app
• Reverse engineer, copy, or exploit Aeva's software or systems
• Use Aeva to violate another person's rights
• Upload malware or harmful code
• Misuse the AI features
• Attempt to access another user's account or data
• Use Aeva in a way that could harm Aeva AI, other users, or third-party services

We may suspend or terminate your account if you breach these Terms or misuse the app.

You may delete your account through the app.

When you delete your account, Aeva AI will delete or anonymise your account data and associated user content, unless we are legally required to keep certain information.

Deleted data may include:

• Account details
• Recipes
• Cookbooks
• Uploaded recipe photos
• Favourites
• Meal planning data
• App preferences

Some data may remain temporarily in backups or logs for security, fraud prevention, technical, or legal reasons.

Deleting your account does not automatically cancel your Apple subscription. You must cancel your subscription through your Apple account settings.

Your use of Aeva is also governed by our Privacy Policy.

The Privacy Policy explains what data we collect, how we use it, how it is stored, and how you can contact us about privacy matters.

You should read the Privacy Policy before using Aeva.

We aim to keep Aeva available and working properly, but we do not guarantee that the app will always be available, uninterrupted, secure, or error-free.

Aeva may be updated, changed, suspended, or discontinued at any time.

Some features may not work if third-party services, internet access, app stores, cloud services, or AI providers are unavailable.

We may update, improve, remove, or change parts of Aeva from time to time.

This may include changes to:

• Features
• AI extraction
• Recipe importing
• Cookbooks
• Meal planning
• Subscription access
• User interface
• Supported services

We will try to avoid unreasonable disruption, but we cannot guarantee that every feature will remain available permanently.

Aeva, including its name, branding, design, software, features, interface, graphics, logos, and original content, belongs to Aeva AI or its licensors.

You must not copy, reproduce, distribute, modify, or create derivative works from Aeva without permission.

These Terms do not give you ownership of Aeva's intellectual property.

Subject to these Terms and your active subscription, Aeva AI grants you a limited, personal, non-exclusive, non-transferable, revocable licence to use Aeva for your own personal use.

You may not sell, rent, sublicense, copy, modify, or commercially exploit Aeva without our written permission.

Because Aeva is distributed through the Apple App Store, your use of the app may also be subject to Apple's terms, conditions, and policies.

If there is a conflict between these Terms and Apple's applicable App Store terms, Apple's terms may apply where required.

To the maximum extent permitted by law, Aeva AI is not liable for any loss, damage, injury, claim, cost, or expense arising from:

• Your use of Aeva
• Your reliance on recipes or AI-generated content
• Incorrect or incomplete recipe information
• Food allergies, dietary issues, or food safety problems
• Lost or deleted data
• App errors, downtime, or service interruptions
• Third-party services
• Subscription or payment issues handled by Apple

Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law or other applicable laws.

Aeva is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we do not guarantee that Aeva will be accurate, reliable, uninterrupted, secure, error-free, or suitable for your specific needs.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law or other laws that cannot legally be excluded.

Where we are permitted to limit our liability, our liability will be limited to the maximum extent allowed by law.

You may stop using Aeva at any time.

We may suspend or terminate your access to Aeva if:

• You breach these Terms
• You misuse the app
• Your subscription ends
• We are required to do so by law
• Continuing to provide access creates risk for Aeva AI, users, or third-party services

After termination, you may lose access to your account and saved content.

We may update these Terms from time to time.

If we make significant changes, we may notify you through the app, website, or other reasonable means.

Your continued use of Aeva after the Terms are updated means you accept the updated Terms.

These Terms are governed by the laws of Western Australia, Australia.

You agree that disputes relating to these Terms or your use of Aeva will be handled in the courts of Western Australia, Australia, unless applicable law requires otherwise.
